Terms and Conditions.

Please carefully review all of the following terms and policies of Yoga Commons, LLC, a Virginia limited liability company (“Yoga Commons”). By signing this document below and/or signing up for a Yoga Commons class, event, retreat or other service (each an “Event”), you are agreeing to the terms and conditions outlined below.

Notice

Before participating in an Event offered by Yoga Commons, you should consult with a physician. Individuals under eighteen (18) years of age must be accompanied by a parent or legal guardian who has accepted these terms and conditions on behalf of the minor.

Voluntary Participation

By accepting these terms and conditions below, you understand and hereby acknowledge that you have voluntarily chosen and requested to participate in an Event.

Acknowledgment and Assumption of Liability

You acknowledge and understand there are risks inherent in participating in the Event, including without limitation the risk of sustaining injury while participating in the Event. You hereby represent that you possess the level of health, strength, and flexibility necessary to participate in the Event, and you understand and hereby acknowledge there still remains a risk of injury. You hereby agree to assume and accept all risks and to assume all responsibility and liability for any and all injuries that you may sustain due to your participation in the Event.

You further hereby acknowledge and understand there are inherent risks associated with travel and group gatherings, including without limitation the risk of contracting COVID-19 or any other infectious disease. You assume all responsibility and liability for any and all damages and costs that may accrue while participating or related to your participation in the Event.

Release, Waiver, and Indemnity

In consideration for being permitted to participate in the Event, you and your legal representatives, successors, and/or assigns agree to waive, release, and hold harmless Yoga Commons and its officers, managers, members, agents, instructors, employees, and other Event participants from any liability, loss, claim, and demand that may accrue from any loss, damage, or injury to your person or property, in any way resulting from, or arising in connection with, the Event.

Yoga Commons has the right to print, reproduce and use images from classes, events, and retreats for marketing and other business purposes. These images may be distributed in print or on the internet in any form.

You have carefully read the Release, Waiver, and Indemnity provisions set forth above, fully understand their terms and contents, and understand you have given up substantial rights by accepting these terms and conditions below. You have accepted these terms and conditions freely and voluntarily and are at least eighteen (18) years of age or your parent or legal guardian is accepting on your behalf.

Payment Terms and Cancellations

A $500 non-refundable and non-transferable deposit is required to secure your space for a retreat with Yoga Commons. Payment in full is required for registrations made within 45 days of a retreat. If the retreat balance is not paid in full 30 days prior to the retreat start date, Yoga Commons reserves the right to cancel the booking and fill the space without a refund.

Cancellations made up to 90 days before the retreat will receive a full refund, minus the $500 deposit. Cancellations made up to 45 days prior to the retreat will receive a 50% refund, minus the deposit. No refunds will be issued within 45 days of the retreat, but Yoga Commons will honor your spot if you would like to gift it to someone else. The person must be on our roster within 2 weeks (14 days) of your cancellation request.

Should Yoga Commons need to cancel the retreat for any reason, including but not limited to: illness, physical deterioration or family emergency, you will receive a full refund (minus nonrefundable deposit). If we have not met the minimum registrations 45 days prior to the retreat start date, Yoga Commons reserves the right to cancel the event. You will have the choice between a refund of your payments (minus the non-refundable deposit), or transferring your full payment to another retreat taking place within 12 months. 

In case a retreat must be canceled due to a natural disaster, act of terrorism, political unrest or any other situation making travel to the location impossible and/or too dangerous, you may receive a percentage of payment made, minus the nonrefundable deposit, depending on the resort/hotel refund policy.

Flights, additional accommodations, transportation costs or travel expenses are not refunded in any situation. These agreements are between you and the provider/travel agent/broker and Yoga Commons is not responsible for them. We recommend purchasing travel insurance to protect your investment.

Third Party Vendors

During retreats and other events, there may be third-parties providing services, including catering, transportation, and lodging. Yoga Commons is not responsible for the acts or omissions of any of these third parties. Although Yoga Commons strives to provide the best services and products available, we have no control over such third parties and are not responsible or liable for any products, materials, or services, or the lack thereof. The user further acknowledges and agrees that Yoga Commons is not responsible or liable, directly or indirectly, for any damages or loss caused or alleged to be caused by or in connection with use of or reliance on such third parties, goods or services.

Retreat Disclaimers

The total cost listed on the website is per person in USD and does not include airfare to the destination airport. Optional outings are at an additional cost. 

All reservations and bookings are first come, first served. We do not hold spots or rooms without a deposit for any length of time. 

Yoga Commons is not responsible for lost, stolen or missing items while traveling to, traveling from, or during the retreat. If you book a shared room and do not specify a roommate, we will pair you with another same-sex traveler. 

Yoga Commons is not responsible for airline cancellations, missed flights or transportation issues prior to or after the retreat. You may incur additional transportation charges to the resort if you miss your flight and are unable to ride with the pre-scheduled shuttles. Travel insurance is not included in the price of the retreat but is highly recommended for ultimate protection.

We reserve the right to cancel booking without refund and/or refuse service to any participant who displays or is said to display violent behavior of any kind before or during the retreat.

While we try to accommodate most dietary preferences, any changes to a retreat’s menu that cause a change in cost will be passed on to the individual making the request.

By paying your deposit for the retreat, you are confirming that you have read and agree to all terms and conditions.

Changes to the Terms of Use

Yoga Commons may change this agreement from time to time in the exercise of Yoga Common’s discretion and Yoga Commons will post a notice on Yoga Common’s website in such situations. Your continued use of Yoga Common’s website following Yoga Common posting any such changes means that you have accepted those changes.

Governing Law and Legal Fees

The laws of the Commonwealth of Virginia shall govern this agreement, without reference to any of its conflicts of law principles. Should Yoga Commons and/or any of Yoga Common’s members, officers, agents, employees and/or independent contractors be required to incur attorneys’ fees and/or other costs in order to enforce this agreement, you hereby agree to reimburse such parties for any and all such fees and costs.
